What this notice covers

This website, the referral form, Commissioner Pack requests, the Dudley proposal page, the register-interest form, the safer recruitment application we email after a first application, and emails you send us. When you apply for a job, our recruitment system has its own privacy notice, which you will see before you apply. Children who live in our homes, and their families, receive a separate notice written for them.

What we collect and why

Registering interest in forthcoming roles. Your first name, last name, email, mobile number, the roles and locations you tick, your CV, and how you heard about Inkfish, so we can contact you when those roles open. These details are stored in our recruitment system, not in our customer records. Our lawful basis is consent.

Safer recruitment applications. After a first application we may email you a private form. That form collects date of birth, employment history and referees, experience, qualifications, DBS and right-to-work answers, so we can complete the checks required before someone joins a children’s home. These details are stored in our recruitment system. Our lawful basis is legitimate interests. Where the information includes criminal-record data we also rely on the employment and safeguarding conditions in Schedule 1 of the Data Protection Act 2018.

Commissioner Pack requests. Your name, organisation, role, email and telephone number, so we can check your request, send the pack and answer any follow-up. Our lawful basis is legitimate interests: responding to professionals who ask for information about our services.

Dudley proposal page. If you unlock or send figures on that page, we collect your name, role, work email and phone number, the figures you change, and the outline proposal those figures produce. We use them only to follow up on that proposal. Our lawful basis is legitimate interests: responding to a council that is checking a proposal we prepared for them.

Referrals. Your contact details, and information about the child that does not identify them: age, sex, legal status, current placement, needs, education and the support needed. We use it to decide whether one of our homes could meet the child’s needs. Our lawful basis is legitimate interests. Where a referral includes information about a child’s health or needs, we also rely on Article 9(2)(h) of the UK GDPR (the provision of health or social care) and the related conditions in Schedule 1 of the Data Protection Act 2018. Fuller records are only requested later, by secure email.

Job referral registrations. Your name, email and phone number, used to send you your referral link and to pay any referral bonus.

Emails and enquiries. Whatever you choose to send us, used to reply. Our lawful basis is legitimate interests.

Who we share it with

We never sell your information. We share it only with:

  • the companies that run our systems for us, such as our email, forms and records providers, under contracts that require them to keep it secure and use it only on our instructions;
  • the placing authority and professionals involved in a referral, where that is needed to plan a child’s care;
  • Ofsted, the police or other bodies where the law requires it, or where it is needed to protect a child.

If one of our providers processes information outside the UK, we make sure it is protected by UK adequacy regulations or the UK International Data Transfer Agreement.

How long we keep it

  • Commissioner Pack requests: two years from our last contact with you.
  • Dudley proposal page: two years from our last contact with you.
  • Referrals that do not lead to a placement: twelve months from the referral.
  • Referrals that lead to a placement become part of the child’s record, which the Children’s Homes (England) Regulations 2015 require us to keep for much longer.
  • Register-interest details: until you ask us to stop, or two years from our last contact with you.
  • Safer recruitment applications: kept with the recruitment record for as long as safer recruitment and employment law require.
  • General emails: two years, unless they form part of a record we must keep for longer.

Keeping it safe

Access is limited to the people who need it. We ask for sensitive documents about a child only by secure email, never through this website.
