What this notice covers
This website, the referral form, Commissioner Pack requests and emails you send us. When you apply for a job, our recruitment system has its own privacy notice, which you will see before you apply. Children who live in our homes, and their families, receive a separate notice written for them.
What we collect and why
Commissioner Pack requests. Your name, organisation, role, email and telephone number, so we can check your request, send the pack and answer any follow-up. Our lawful basis is legitimate interests: responding to professionals who ask for information about our services.
Referrals. Your contact details, and information about the child that does not identify them: age, sex, legal status, current placement, needs, education and the support needed. We use it to decide whether one of our homes could meet the child’s needs. Our lawful basis is legitimate interests. Where a referral includes information about a child’s health or needs, we also rely on Article 9(2)(h) of the UK GDPR (the provision of health or social care) and the related conditions in Schedule 1 of the Data Protection Act 2018. Fuller records are only requested later, by secure email.
Emails and enquiries. Whatever you choose to send us, used to reply. Our lawful basis is legitimate interests.
Who we share it with
We never sell your information. We share it only with:
- the companies that run our systems for us, such as our email, forms and records providers, under contracts that require them to keep it secure and use it only on our instructions;
- the placing authority and professionals involved in a referral, where that is needed to plan a child’s care;
- Ofsted, the police or other bodies where the law requires it, or where it is needed to protect a child.
If one of our providers processes information outside the UK, we make sure it is protected by UK adequacy regulations or the UK International Data Transfer Agreement.
How long we keep it
- Commissioner Pack requests: two years from our last contact with you.
- Referrals that do not lead to a placement: twelve months from the referral.
- Referrals that lead to a placement become part of the child’s record, which the Children’s Homes (England) Regulations 2015 require us to keep for much longer.
- General emails: two years, unless they form part of a record we must keep for longer.
Keeping it safe
Access is limited to the people who need it. We ask for sensitive documents about a child only by secure email, never through this website.
Your rights
You can ask for a copy of your information, and ask us to correct it, delete it, restrict how we use it or stop using it. You can also object to how we use it. Email privacy@inkfishcare.com. We will reply within one month.
If you are unhappy with how we have handled your information, you can complain to the Information Commissioner’s Office: ico.org.uk, telephone 0303 123 1113.
